Agreement to Terms

By accessing and using HOREKMART (www.horekmart.com), whether as a customer or vendor, you accept and agree to be bound by the terms and provisions of this agreement. This includes accessing our platform through social media authentication (TikTok, Facebook, Google) for dashboard login.

These terms apply to all visitors, users, customers, vendors, and others who access or use our service through any means, including web, mobile, or social media integration.

If you do not agree to these terms, you should not use our website or services.

About Horekmart

Horekmart is a multi-vendor ecommerce platform that connects customers with multiple vendors. Our platform enables:

Customers to browse and purchase products from various vendors
Vendors to manage their products, inventory, and orders through a dedicated dashboard
Secure authentication through traditional methods or social media login
Streamlined order processing and fulfillment
Integrated payment and shipping solutions

User Accounts

Account Creation & Authentication

Create account via email/phone or social media
Provide accurate, current, and complete information
Maintain security of your password and account
One account per person or business entity
Must be 18 years or older to use services

Account Responsibilities

Accept responsibility for all activities under your account
Notify us immediately of unauthorized access
Comply with all applicable laws and regulations
Do not share account credentials with others
Maintain accurate profile and business information

Social Media Authentication

Horekmart offers convenient login through social media platforms (TikTok, Facebook, Google) for both customers and vendors to access their dashboards. By using social login:

You authorize us to access basic profile information from your social media account
You agree to comply with the respective platform's Terms of Service
You understand we only access information you explicitly authorize
You can disconnect your social media account at any time from account settings
You remain responsible for maintaining the security of your social media account
You acknowledge that social media platforms may independently collect data per their policies

Linking your social media account does not grant us permission to post on your behalf or access information beyond what is necessary for authentication.

Vendor-Specific Terms

If you are registering as a vendor on Horekmart, you additionally agree to:

Vendor Obligations

Provide accurate product information and pricing
Fulfill orders promptly and professionally
Maintain adequate inventory levels
Respond to customer inquiries in a timely manner
Comply with all applicable laws and regulations
Honor return and refund policies

Vendor Restrictions

No counterfeit or unauthorized products
No misleading product descriptions
No price manipulation or unfair practices
No circumventing platform fees
No harassment or inappropriate conduct
No violation of intellectual property rights

Acceptable Use

You agree not to use Horekmart for any unlawful or prohibited activities, including but not limited to:

Violating any local, state, national, or international law
Infringing upon intellectual property rights
Transmitting harmful code, viruses, or malicious software
Attempting unauthorized access to our systems
Harassing, threatening, or defrauding other users
Scraping or automated data collection without permission
Creating fake accounts or impersonating others
Posting false or misleading information
Interfering with platform operations or other users

Intellectual Property Rights

All content on Horekmart, including text, graphics, logos, images, software, and other materials, is the property of Horekmart or its content suppliers and is protected by intellectual property laws.

You may not reproduce, modify, or distribute our content without permission
Product listings and vendor content are owned by respective vendors
User-generated content remains your property but you grant us usage rights
We respect intellectual property rights and expect users to do the same
Report infringement to legal@horekmart.com

Transactions and Payments

Customer Obligations

Provide valid payment information
Pay all charges incurred
Ensure billing information is accurate
Authorize charges for orders placed
Accept responsibility for payment disputes

Vendor Payments

Receive payments per vendor agreement
Platform fees deducted as agreed
Payout schedules based on policy
Tax obligations are vendor responsibility
Refunds processed according to policy

Privacy and Data Protection

Your use of Horekmart is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services:

You consent to our collection and use of personal data as described in the Privacy Policy
You acknowledge data collected through social media login follows our Privacy Policy
You understand vendors may access customer information necessary for order fulfillment
You have rights to access, correct, or delete your personal data
You can manage social media connections through account settings

Account Termination

Either party may terminate this agreement:

You may close your account at any time from account settings
We may suspend or terminate accounts for violations of these Terms
We may terminate accounts for fraudulent or illegal activity
Vendors may be removed for poor performance or policy violations
Termination does not affect completed transactions
Certain provisions survive termination (payment obligations, liability limitations)

Disclaimers and Limitations

Horekmart is provided "as is" without warranties of any kind. We do not guarantee uninterrupted, error-free service.

We are not responsible for vendor actions or product quality
We do not guarantee product availability or pricing accuracy
Social media platform availability is beyond our control
We are not liable for third-party service interruptions
Users are responsible for data backup
We are not liable for consequential or indirect damages

Indemnification

You agree to indemnify and hold harmless Horekmart, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from:

Your use of the platform
Violation of these Terms
Violation of any rights of third parties
Content you submit or transmit
Your breach of any law or regulation
Your vendor activities if applicable

Dispute Resolution

Any disputes arising from these Terms or use of Horekmart shall be resolved as follows:

First attempt resolution through customer support
Mediation may be pursued before legal action
Disputes governed by laws of Bangladesh
Jurisdiction: Courts of Nilphamari, Bangladesh
Arbitration may be required for certain disputes
Class action waivers may apply

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through:

Email notifications to registered users
Prominent notice on our website
In-dashboard notifications for vendors
Updated "Last Modified" date at the top

Continued use of Horekmart after changes constitutes acceptance of modified Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
